Dear Mr. Clark,
Thank you so much for your letter from April 21st. The contract with the Theatre Guild has been signed fifteen years ago. I have no copy. The contract was among the papers which were confiscated and destroyed by the Nazis in my Berlin flat. MASSES AND MAN was sold to the Theatre Guild through Kiepenheuer. Since Hitler came to power in 1933 my contract with Kiepenheuer has expired. I am now the only owner of the rights of my works. If the recent standard contract gives to the professional manager a 50% share in the acting rights only for a period of three years then is, in my opinion, the situation clear and royalties must not be paid to the Theatre Guild.
There are two translations of MASSES AND MAN, one by Louis Untermeyer and one by Vera Meynell. If the play is produced from the translation by Vera Meynell I get my whole share less the agent’s fee. (Vera Meynell who is a friend of mine has been so kind to desist from her share.)
As far as Untermeyer is concerned I have no knowledge at all. Be so kind and go in touch with him and settle the question.
I should like very much indeed if you would act as my exclusive agent for amateur acting rights.
LIVERIGHT who has published my SEVEN PLAYS has only the book rights. I can assure you that there is no other party implicated either as agent or part owner.
In the autumn I shall come over to U.S.A. for a lecture tour and I look very much forward to see you again.
